- Before and after NAGPRA: the effect of the Native American Graves Protection and Repatriation Act on archaeological practices in the United States.

- Ray, Laura., Harriet L. Wilkes Honors College
- Abstract/Description

The Native American Graves Protection and Repatriation Act (NAGPRA) was approved by Congress on November 16, 1990 after years of American Indian lobbying due to the unfair treatment of American Indian remains. Since the enactment of NAGPRA there have been multiple complaints from the archaeological community that the way in which they conduct their jobs has been severely limited by the implementation of NAGPRA. In this study I compare data from the Secretary's Report to Congress questionnaire...
Show moreThe Native American Graves Protection and Repatriation Act (NAGPRA) was approved by Congress on November 16, 1990 after years of American Indian lobbying due to the unfair treatment of American Indian remains. Since the enactment of NAGPRA there have been multiple complaints from the archaeological community that the way in which they conduct their jobs has been severely limited by the implementation of NAGPRA. In this study I compare data from the Secretary's Report to Congress questionnaire, conducted by the National Park Service's Federal Archaeology Program, to determine whether NAGPRA has caused an increase or decrease in the amount of archaeological administrative, laboratory, and fieldwork completed between 1985 and 2005. The comparison shows that there was a significant increase in specific archaeological practices in the years following the implementation of NAGPRA. Looking at the changes in work patterns of archaeologists allows us to assess the success of NAGPRA and it provides empirical evidence to evaluate the claims made by parties affected by the act.

- A comparative analysis of the French and American judicial systems and the cultural effects of judicial decisions.

The histories of France and the United States of America are often compared alongside the judicial systems of each country. While the histories of the countries, starting with the French and American revolutions, have similarities, the judicial systems themselves are based on different schools of thought. The French method of judicial decision making is based on the Napoleonic code whereas the American method is based on that of common law. In available literature regarding comparisons of...
Show moreThe histories of France and the United States of America are often compared alongside the judicial systems of each country. While the histories of the countries, starting with the French and American revolutions, have similarities, the judicial systems themselves are based on different schools of thought. The French method of judicial decision making is based on the Napoleonic code whereas the American method is based on that of common law. In available literature regarding comparisons of France and the United States, it is an assumption that, if the American and French judicial systems are based on different legal theories, the cultural effects of those systems must also be different. Contrary to these expectations, however, my analysis of court cases focusing on labor unions' right to strike demonstrates that there are similarities in judicial decisions' effects on society.

- Creating conservation: the role of zoos in the future of biodiversity conservation.

Once seen as entertainment organizations, many American zoos now strongly promote themselves as agencies of biodiversity conservation, a reorientation prompted in part by growing public concern about endangered species. Funding, research, conservation efforts, and captive breeding programs are the concrete tools that allow zoos to lay claim to their contributions, but it is their more subtle cues that leave a lasting impression with zoo visitors. Funding, research, conservation efforts, and captive breeding programs are the concrete tools that allow zoos to lay claim to their contributions, but it is their more subtle cues that leave a lasting impression with zoo visitors. The exhibits, layout, signage, and presentations reflect prevailing attitudes about nature, wildlife, exotic species, and shape ideas about how animals live their lives and what they are like in the wild. This project examines tensions between the public presentation of conservation goals and concrete contributions to conservation. Zoos are one of the few places where the public can see firsthand many animals in an up-close environment and the impact of zoos on the future of conservation may be dependent upon resolving such tensions.

- "The depths of an English heart": Wittgenstinian private language in Ford Madox Ford's The Good Soldier.

- Abstract/Description

In Ford Madox Ford's 1915 novel The Good Soldier, John Dowell comments "I had never sounded the depths of an English heart," as he painstakingly reconstructs his "extreme intimacy" with his late wife and their two closest friends. Throughout his narrative, Dowell approaches the limits of language, struggling to connect with lost companions by bringing language into scenes of miscommunication and silence. Show moreIn Ford Madox Ford's 1915 novel The Good Soldier, John Dowell comments "I had never sounded the depths of an English heart," as he painstakingly reconstructs his "extreme intimacy" with his late wife and their two closest friends. Throughout his narrative, Dowell approaches the limits of language, struggling to connect with lost companions by bringing language into scenes of miscommunication and silence. By translating emotional impasses and wordless exchanges from memory into narrative, Dowell seems to make these wordless interactions wordful. Ludwig Wittgenstein's investigation into "private language" helps elucidate Dowell's realization that he cannot fill wordlessness with words to reconstruct his memories. If Dowell can't fill wordlessness with words, his failure to "sound the depths of an English heart" isn't a failure at all, but rather an exposition on "private language" as public language, demonstrating that misunderstandings can be our best attempts at understanding each other.

- A fistful of facts: reconsidering Dziga Vertov's cinematic truth.
- Creator

In 1919, the Soviet filmmaker Dziga Vertov declared a "death sentence" on fictional films. Vertov championed his own unique method of non-fiction filmmaking, called Kino-Eye, which is based on Vertov's ideas regarding truth in cinema. Although he does not write specifically about Vertov or film, the philosopher Nelson Goodman offers a contrasting view of truth in general. Although he does not write specifically about Vertov or film, the philosopher Nelson Goodman offers a contrasting view of truth in general. - Abstract/Description

Is beauty really in the eye of the beholder? Historically, philosophers, poets, artists, and scientists have striven to define and express one of the most complex words in the English language : beauty. In contemporary society we tend to casually ascribe the word beauty to many various objects, paintings, sounds, and ideas. Its meaning can adhere to a stone, to the oscillating waves of an ocean, to the nonorganic as to the organic. Perceptions of Beauty is a project the follows my journey as...

Perceptions of Beauty is a project the follows my journey as an artist and how my perception of beauty has changed over the past four years. Using examples from select artists, philosophers, and scientific studies, I will contend that Beauty is not "in the eye of the beholder," but is a complex and formulated characteristic that inspires not only an emotional response, but evokes mechanisms that defy our understanding of ourselves.

- Punishing a person for another's crime: the felony-murder rule.
- Creator
- Gomez, Lauren Theresa, Harriet L. Wilkes Honors College
- Abstract/Description

The felony-murder rule declares that if a death occurs during the commission of a felony, all persons involved in the felony will be held culpable for the death. The rule makes every person equally culpable for the death, regardless of his or her mental state and degree of involvement during the crime. Drawing on theories of punishment and scholarship on culpability, I argue that the felony-murder rule needs to be modified. Each person involved in the crime should not be held accountable for...

Drawing on theories of punishment and scholarship on culpability, I argue that the felony-murder rule needs to be modified. Each person involved in the crime should not be held accountable for the actions of another, but should only be held responsible and culpable for their own intended actions.
