Show morePublic asset management is a critical component of the financial integrity of government. However, in practice, problems exist in the field of public asset management at different levels of government in the United States. This research explores the management of public fixed assets owned, controlled and used by state governments in America. It attempts to answer two major questions: (1) What are the characteristics of a modern public asset management system based on the available literature? and (2) How do public asset management practices at the U.S. state government compare to the system standard described in the first question? Based on systems theory and current research on public asset management and public procurement systems, this research develops an intellectual framework of a public fixed asset management system. This system is composed of six interdependent cornerstones, including legal and regulatory requirements, organization structure, management process throughout th e life cycle of assets, human capital strategies, information and technology resources, and monitoring, integrity, and transparency. Each cornerstone consists of a number of components that reveal the underlying working principles of the relevant cornerstone and together determine the standards of fixed asset management in the relevant area. Survey results demonstrate that state governments fundamentally satisfy the standards identified in the fixed asset management system. However, certain problems obviously exist in the area of each cornerstone. In addition, survey results reveal that the six cornerstones of fixed asset management system are interrelated with one another. In most states, when a management element in the area of one cornerstone is widely implemented, the relevant management elements in areas of other cornerstones are employed and vice versa., A major contribution of this research is the development of a fixed asset management system. State and federal governments may compare their fixed asset management to the standards identified in this system. Local governments may find appropriate management components to adapt to their characteristics from this system.

Show moreCatastrophic event emergency planning has emerged as one of the most important operations management areas. Much of the successes of a response plan rely on the ability to maintain an operating transportation infrastructure. In recent years urban areas have become susceptible to biological terrorist attacks due to their size and demographics. To mitigate the devastating effects of an attack, a comprehensive catastrophic event response plan is devised. The characteristics of the disease (dormant periods, signs/symptoms), daily traffic operations and trip distributions, patient-choice hospital modeling and emergency center corridor optimization are all elements of an effective response plan. Simulation and optimization modeling of this plan becomes a faster-than-real-time tool in replicating urban area degradation. Therefore, allowing planners to identify "worst case scenarios" within the network and implement Dynamic Traffic Assignment (DTA) techniques and a non-linear departure time slot allocation mathematical model ensuring infected populations receive treatment and/or vaccinations efficiently.

As a retributivist, I believe we should only punish those who are culpable. Following this assumption, I argue that courts should punish entrapped people if they are culpable and that the subjective test, which holds that a defendant is culpable if he was predisposed to commit the crime, should be the standard by which courts judge defendants who claim entrapment. As a retributivist, I believe we should only punish those who are culpable. Following this assumption, I argue that courts should punish entrapped people if they are culpable and that the subjective test, which holds that a defendant is culpable if he was predisposed to commit the crime, should be the standard by which courts judge defendants who claim entrapment. The objective test, which focuses on the propriety of the government conduct, fails to accurately assess culpability because, under this test, the guilt of the defendant depends largely on what the average person would have done under the same circumstances. I also propose that if government conduct reached the level of outrageous, defendants found to be predisposed may claim that the government violated their right to due process.

Show moreComparative performance measurement is an anathema to most government officials. While internal comparison with national benchmarks or other similar agencies is an accepted management analysis tool, public comparisons are deemed too politically risky for all but a few governments, agencies, and non-profits. To avoid the unappealing prospect of being unfavorably ranked versus comparable agencies, governments cite two primary objections. First, performance measurement is considered an inexact science, subject to manipulation of input data and outcome scores that affects comparisons. Second, comparative measurement is considered unfair by governments because they maintain each operates in a unique environment of demographic and physical characteristics beyond their control which have significant effects on their ability to deliver quality services. This research addresses both of these objections to comparative performance measurement. It uses trained observer ratings, an accepted objective measurement system, and utilizes a scoring scheme that results in a ratio variable outcome score appropriate for comparisons and statistical analysis. The model was employed for external random testing of street appearance across 30 governments in Broward County, Florida, eliminating the possibility of manipulation by those being measured. In addition, the research evaluates the effects of twelve independent variables, which measure characteristics of each community's unique environment. The research question is whether the effects of the external environmental factors on the composite street rating scores are so significant as to make comparisons meaningless, as government officials contend. The findings of this research do indicate that white, educated, affluent residents tend to live in cities with better streets and that environment is an important element in street appearance. Further, the standard deviation scores indicate that the more diversity in the environment of a city, the more diversity in the quality of its streets. Nonetheless, the conclusion of the research is that although environment is significant, the methods and findings of the model can be employed to control for environmental effects in future comparative performance efforts to assuage the concerns of governments being compared.

When the federal government dominated welfare policy, only three acts passed, all 20+ years apart--the 1935 Social Security Act, 1964 Economic Opportunity Act and 1988 Family Support Act. Then states, like Florida, became more involved in welfare reform through state waivers after the Family Support Act. Money, voter perceptions, and the states avoidance of becoming welfare magnets led to the shift of control to the states. All of their actions had to be approved by federal government state waivers. Florida, being influenced by the federal welfare dependency and culture of poverty ideologies did more in the next few years than the federal government did in the 60 years prior. The federal 1996 Welfare Reconciliation Act continues the partnership by them still working together and more policy innovation continuing to to be seen in welfare reform.

Show moreI examine the impact of real earnings management (REM) and corporate governance on cash holdings. Extant research documents an increase in both cash holdings and REM activity in recent years and shows that agency conflicts influence both the levels and valuations of cash holdings. Motivated by agency problems of REM and Jensen's (1986) arguments concerning the free cash flow problem, I investigate whether opportunistic asset sales and reductions in discretionary expenditures are associated with levels and valuations of cash holdings. Prior research also shows that strong corporate governance mitigates opportunistic earnings management behavior and enhances the valuation of cash holdings. Using empirical models from prior research, I document that REM is positively associated with cash holdings, investors discount cash holdings of high REM firms, and, among high REM firms, valuations of cash holdings of weak corporate governance firms are discounted significantly lower relative to those of strong corporate governance firms. My study unites two lines of research by incorporating agency problems concerning REM with levels and valuations of cash holdings.
